Touch ‘n Go Shop Campaign Promotion(s)

These terms and conditions (“Terms and Conditions”) govern the promotional campaign (“Campaign”) by Touch ‘n Go Sdn. Bhd. (“Touch ‘n Go”) on the Touch ‘n Go Shop (“Platform”). By participating in the Campaign, you agree to be bound by these Terms and Conditions and any applicable rules and conditions.

  1. Touch ‘n Go Go Shop Always-On Promotions:

    These promotions are available throughout the year with no expiry date:

  3. How to Redeem and Use Promo Codes
    • To redeem a Promo Code:
      • You must have a registered and valid Platform account;
      • You can only apply one Promo Code per checkout;
      • The Promo Code must be used within its validity period. For clarity, Touch ‘n Go Shop Always-On promotions do not have an expiry date unless you have already claimed the promotion;
      • The Promo Code shall only be valid if all applicable conditions are met, which may include the following:
        • user eligibility– for example, the promotion may be limited to new users who have not previously redeemed the first purchase promotion;
        • purchase criteria– for example, a minimum spend requirement (e.g. RM50, excluding the purchase of Touch ‘n Go Generic Card), or applicable only to specific products or categories;
        • promotion period– the promotion shall only be valid within the specified campaign period or during a limited-time offer;
        • eligible products– the promotion may only be used for designated Touch ‘n Go products;
        • discount limitations– including but not limited to any applicable caps or maximum discount value; and
        • usage restrictions– including, but not limited to, one-time use per user, non-transferability, and non-stackability with other promotions or offers.
    • Unused or expired Promo Codes:
      • cannot be extended, exchanged for cash or refunded;
      • cannot be used retroactively or partially; and
      • will be forfeited automatically after its expiry.
    • Promo Codes:
      • must be applied at checkout;
      • only valid for purchases made through the Platform;
      • have no cash value and cannot be sold, exchanged or transferred.

    4. General Terms and Conditions

  4. By participating in the Campaign, you agree to the following:
    • Compliance with Terms and Conditions: You agree to comply with and be bound by these Terms and Conditions of the Campaign, including any subsequent amendments or variations made by Touch ’n Go to these Terms and Conditions as well as any decisions made by Touch ’n Go in relation to the Campaign;
    • Processing of Personal Data: You authorise and consent for Touch ’n Go to process, collect, record, hold, store, use, and disclose your personal information and data (“ Personal Data ”) in accordance with Touch ’n Go’s Privacy Notice for purposes which are necessary and/or related to your participation in the Campaign. You confirm that this consent covers all necessary processing of your Personal Data, and no further permission is required. You also confirm that the Personal Data provided to Touch ’n Go is complete and accurate;
    • Disclosure of Personal Data: You permit Touch ’n Go to disclose and/or publish your Personal Data as well as any general information, on any media, marketing, or advertising materials as Touch ’n Go deemed appropriate, subject to applicable data protection laws; and
    • Use of Images and Captions: Where applicable, you grant Touch ’n Go a perpetual, worldwide, irrevocable, royalty-free, and sublicensable right to use, modify, reproduce, distribute and publish any still or moving images and written captions featuring or provided by you for any promotional, marketing, commercial, or other related purposes, in any media now known or developed in the future, without any further consent or compensation.
  5. Exclusion of Liability: Touch ’n Go (including Touch ’n Go’s subsidiaries, affiliates, associated companies, and related corporations (as defined in Companies Act 2016)) will not be liable for any loss (including indirect, special, consequential loss or loss of profits), expense, or damage suffered or sustained by you in connection with the Campaign, except for liability that cannot be legally limited or excluded.
  6. Prevailing Terms: These Terms and Conditions will prevail over any inconsistent terms, conditions, provisions, or representations in any other promotional or advertising materials for the Campaign.
  7. Right to Amend: Touch ’n Go reserves the right to vary, delete, or add to any of these Terms and Conditions by providing seven (7) calendar days’ notice via eDM. Touch ’n Go’s decisions regarding the Campaign are final, binding, and conclusive, and no correspondence, complaint, or appeal will be entertained.
  8. Governing Law and Dispute Resolution: These Terms and Conditions are governed by the laws of Malaysia. Any disputes arising from these Terms and Conditions will be settled by mutual consultation and consent. If such dispute cannot be resolved, the dispute shall be submitted to the exclusive jurisdiction of the courts of Malaysia.
  9. No Waiver: No failure or delay by Touch ’n Go in exercising any right, power, or privilege under these Terms and Conditions will operate as a waiver. A single or partial exercise of waiver does not preclude any other or further exercise of any right, power or privilege.
  10. Severability: If any provision is held to be illegal, invalid, or unenforceable, it will be fully severable, and the remaining provisions will remain in full force and effect.
  11. No Assignment You may not assign or transfer any of your rights and obligations under these Terms and Conditions without Touch ’n Go’s prior written consent. Touch ’n Go may assign its rights and/or benefits under these Terms and Conditions by providing written notice to you.
  12. Disclaimer of Warranties: Subject to applicable laws, Touch ’n Go makes no warranties regarding the Campaign and disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement of any third-party intellectual property rights
  13. Force Majeure: If the Campaign cannot proceed as planned due to circumstances beyond Touch ’n Go’s reasonable control (including but not limited to natural disasters, acts of God, or technical failures), Touch ’n Go reserves the right to withdraw, cancel, terminate, modify, or suspend the Campaign. Touch ’n Go shall not be liable for any loss or damage resulting from the withdrawal, cancellation, termination, or suspension of the Campaign. In the event of actual or suspected fraud or other unlawful conduct, Touch ’n Go reserves the right to take appropriate action, including disqualifying participants or terminating the Campaign.
  14. Responsibility: Touch ’n Go will not be responsible for any loss, harm, damage, injury, costs, fees, and expenses suffered by you if you cannot utilise the promo codes due to your own fault, act, or omission.
  15. Survival of Terms: Paragraphs 4a (Compliance with Terms and Conditions), 4b (Processing of Personal Data), 4c (Disclosure of Personal Data), 4d (Use of Images and Captions), 5 (Exclusion of Liability), 6 (Prevailing Terms), 8 (Governing Law and Dispute Resolution), 9 (No Waiver), 10 (Severability), 11 (No Assignment), 12 (Disclaimer of Warranties), 14 (Responsibility) and 16 (Language) shall remain in full force and effect after the cancellation or expiry of the Campaign.
  16. Language: These Terms and Conditions are provided only in English.
